THE DECISION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON TECHNICAL DIRECTIVES FOR VERIFICATION AND TECHNICAL SURVEILLANCE OF IMPORT OF TEXTILE AND CLOTHING (TPT)

(1) Verification or technical surveillance of import of TPT include:

(2) In the case of import of TPT being worth up to FOB U5$2,500.00, procedures for verification or technical surveillance as meant in paragraph (1) are executed by means of random examination.

(3) Mark of examination is given to goods or transport package of import of TPT already subjected to verification or technical surveillance in the form of seal or label.

(4) Procedures and technical directives for granting the mark of examination as meant in paragraph (3) are made and implemented by surveyors in accordance with the common norms.

(1) Results of the verification or technical surveillance of import of TPT as meant in Article 2 are mentioned in a report of surveyor or LS by surveyor for conveying subsequently to:

Procedures and directives for verification or technical surveillance of import of TPT as meant in Article 2B of decree of the Minister of Industry and Trade No. 389/MPP/Kep/5/2003 on the amendment to Decree of the Minister of Industry and Trade No. 276/MPP/Kep/4/2003 concerning verification or technical surveillance of import of textile and clothing are executed in accordance with the provisions as meant in this decision.

Article 5

(1) With regard to verification or technical surveillance of import of TPT, surveyors entitle to obtain a compensation for their service from the relevant importers whose TPT are subjected to verification or technical surveillance.

(2) The amount of compensation as meant in paragraph (1) is adjusted to the principle of benefit.

(3) Procedures and directives for paying the compensation from the relevant importers of TPT to surveyors are executed in accordance with the common norms.

Article 6

(1) LS as an import document which must be attached in every time of issuance of Import Declaration (PIB) of import of TPT subjected to prior verification or technical surveillance is effective after June 9, 2003.

(2) In the case of imported TPT already arriving at Indonesia after June 9, 2003 but PIB of the said TPT has been submitted by importers of TPT and has secured registry number from the Directorate General of Customs and Excise on or before June 9, 2003, the import is exempted from the obligation to attach LS.

(3) In the case of import of TPT subjected to prior verification or technical surveillance failing to meet the provision in paragraphs (1) and (2), the imported TPT must be re-exported or subjected to other custom provisions in force.

Article 7

The lateness or other mistake in the issuance of LS attributable to negligence of surveyors intentionally or unintentionally becomes responsibility of surveyors in accordance with the provisions effective in the international federation of inspection agencies/IFIA.

Article 8

(1) Surveyors appointed to undertake verification or technical surveillance of import of TPT as meant in Decree of the Minister of Industry and Trade No. 276/MPP/Kep/4/2003 and Decree of the Minister of Industry and Trade No. 307/MPP/Kep/4/2003 must convey a written report on activities of verification or technical surveillance periodically every month in the first week of the following month of execution of the activities to the Director General of Foreign Trade in this case the Director of Import with a copy made available to the Director of Textile and Clothing, Directorate General of Metal, Machine, Electronic and Multifarious Industries, Ministry of Industry and Trade.

(2) The written report by surveyors as meant in paragraph (1) contains the following matters:

Article 9

In the case of surveyors being negligent to convey the written report to the Director General of Foreign Trade in this case the Director of Import, Ministry of Indus try and Trade, as meant in Article 8, intentionally or unintentionally, the Director General of Foreign Trade warns and recommends the revocation of appointment as surveyors.

Article 10

(1) In the case of any dispute or divergent view about the implementation of verification or technical surveillance of TPT, related parties can consult with the team for monitoring and evaluating developments of textile and clothing industries established on the basis of Decision of the Director General of Mental, Machine, Electronic and Multifarious Industries, Ministry of Industry and Trade No. 011/SK/ILMEA/IV/2003.

(2) Results of the consultation as meant in paragraph (1) are not binding, but becomes substances of recommendation of the team for monitoring and evaluating developments of textile and clothing industries for further conveyance to institutions/working units within related ministries authorized to make a decision.

This decision comes into force as from the date of stipulation.
